1. Acceptance of Terms

By accessing and using Discretion AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Age Requirements

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you do not meet this age requirement, you must not access or use the Service. We reserve the right to terminate your access immediately if we suspect you are under the required age.

3. Artificial Intelligence Disclosure & Limitations

IMPORTANT NOTICE REGARDING AI CAPABILITIES

The Service utilizes advanced probabilistic Large Language Models (LLMs) and generative artificial intelligence. You explicitly acknowledge and agree that:

• The AI is not human and does not possess consciousness, true understanding, or moral judgment.
• The AI may generate responses that are inaccurate, incomplete, misleading, or entirely fabricated (often referred to as "hallucinations").
• The AI's output should never be relied upon for medical, legal, financial, professional, or safety-critical advice.
• You bear sole responsibility for verifying any information provided by the Service before taking action based upon it.

4. Acceptable Use & Prohibited Content

You agree not to use the Service to:

• Request, generate, or engage in any illegal content, including but not limited to pedophilia, child sexual abuse material (CSAM), minor roleplay, necrophilia, bomb-making instructions, chemical/biological weapons, terrorism, or real-world self-harm and violence.
• Input sensitive personal data (e.g., social security numbers, banking details, protected health information).
• Reverse engineer, decompile, or attempt to extract the source code or underlying models of the Service.
• Violate any applicable local, state, national, or international laws.

5. 18 U.S.C. § 2257 Exemption Statement

All characters, images, avatars, text, and visual or textual depictions accessible on Discretion AI ("the Service") are entirely 100% synthetically generated by artificial intelligence algorithms. No real human beings or actual human performers were involved in the creation, modeling, or depiction of any content on this website. Consequently, all content on this site is exempt from the record-keeping, labeling, and auditing requirements set forth under 18 U.S.C. § 2257 and 28 C.F.R. Part 75.

6. Disclaimer of Warranties ("As-Is")

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

7. Limitation of Liability

IN NO EVENT SHALL DISCRETION AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

UNDER NO CIRCUMSTANCES WILL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS FOR THE SERVICE.

8. Indemnification

You agree to defend, indemnify, and hold harmless Discretion AI and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your generation and use of AI output.

9. Lifetime Access & Fair Use

"Lifetime access" means access for the operating life of the Service. It is a one-time purchase with no expiry date, no renewal, and nothing to cancel. It does not create a commitment to operate the Service for any particular period, nor to preserve any particular AI model, companion, or feature — these change as the underlying providers and models change.

Lifetime access includes unlimited messages subject to fair use. Fair use is currently a limit of 500 messages per day, which is set far above ordinary use and exists to prevent automated or scripted access from degrading the Service for everyone else. We may adjust this limit, and will not set it below a level that accommodates normal human use.

Included Moments (the credits used for image and voice generation) are granted once at purchase and are not replenished. Additional Moments may be bought separately. If we discontinue the Service entirely, we will give reasonable advance notice.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this site.

11. DMCA & Copyright Takedown Policy

Discretion AI respects the intellectual property rights of others and expects users and creators to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond expeditiously to notices of alleged copyright infringement. If you believe your copyrighted work has been copied or used in a way that constitutes infringement, please submit a written notification to our Designated Copyright Agent at:
